This works entirely externally to WOW using screen reading.
The commands it sends to wow mimic a person fishing (delayed input, plus some other things so a short pattern is not detected)
I have been using it for years now and have not had any issues with banning (North America Servers)
The only real way it could be effectively detected is if your on for 24-48 hours straight as that would stand out in their logs, as it is VERY unlikely for someone to spend 24-48 hours fishing.
I usually run it for 4-5 hours at a time when I use it.

So in the end, yes this is a bot, yes it does go against the Terms of Service (North America at least). as for the probability of getting banned for it? they would have to go out of there way, or other players would have to file complaints against you for them to look into it. They would have no physical proof as it mimics a player, and nothing is running in the wow client or accessing its memory only reading the screen like a person does. You would have to REALLY stand out.

So no guarantees that you will not get banned for using it.
But as I have said I have been using it for 4+ years with no issue, at times I have had it going for 10+ hours, usually in a secluded fishing spot in the game.
