In master OE all the patch files are expected to have 'Upstream-Status:' field.

You should look up the commit/PR, where this patch has been submitted the first time, and add its description. There are also more patches, which doesn't include the upstream status.

Please look at master-next. While this hasn't gone to master yet, it has all of this already resolved.

Can you backport it to Scarthgap? The current scarthgap branch is incompatible to yocto scarthgap.
